Terms & Conditions
At D.M.B. Performance Imports ( www.AE86Parts.com ) we strive to satisfy our customers needs at all costs by focusing largely on our customer service and supplying what we believe to be the best quality products available. Our legal department has however, compiled a list of terms and conditions that all customers should read and familiarise themselves with before ordering or purchasing goods or services from the website or our company.
1. NEW PARTS
The purchase of new parts for any vehicle regardless of Make or Model is strictly non returnable unless the item is damaged by the delivery company or is non operational. In this event a full refund or replacement will be issued to you.
2. DEPOSITS
Deposits placed on ordered items are strictly non refundable under any circumstances.
3. USED PARTS
Used parts for any vehicle regardless of make or model are strictly non returnable unless damaged by the delivery company. Please ensure that you order the correct part to suit your vehicle as refunds or replacements may not be accepted or may be subject to a restocking fee.
4. ENGINES, GEARBOXES, AXELS
Used Engines, Gearboxes, Rear Axel / Differentials and other mechanical parts are sold without warranty, however, all used parts sold by us are tested at time of packaging and will not be dispatched unless in perfect working order. In the unlikely event your purchased product is non operational, Please contact us immediately to allow us decide the fairest action for the situation.
5. SHIPPING BODY PANELS
We do not accept any responsibility for damage sustained to body panels ( New or Used ) such as bonnets, doors or boot lids while in transit for delivery. We wish to advise that most delivery companies refuse to accept such items for delivery due to the high risk of damage but if they do accept, the items are usually not covered by their transport insurance.
6. AFTERMARKET & PERFORMANCE PARTS
Parts purchased from the Aftermarket and Modified section of our website may take between 7 - 21 days for delivery. This is due to the fact that most of these products are high value items of which we do not keep a large stock. In the event of us not having the product in stock we will have them shipped to you directly from our supplier or the manufacturer which is usually based in Asia or the United States. We do not hold large stock of high value Aftermarket and Performance parts and have recently decided to have products shipped directly from the Supplier or Manufacturer to our customers as this method has proved more cost effective for us which enables us to sustain an adequate cash flow in our company and in turn enables us to offer these usually expensive products to our customers at a much lower price.
7. DIFFERENTIALS
We offer an extensive range of Limited Slip Differentials to suit AE86 Corolla / Levin’s and also all other makes and models. It is vitally important that you supply us with the exact and correct information and details of your vehicle such as Make, Model, Version and Chassis Number if requested as we do not accept returns or offer refunds due to incorrect information supplied to us.
8. WHEELS
We offer a wide range of wheels to suit the AE86 Corolla / Levin. We also offer wheels for other makes and models. The wheels listed are to suit the AE86 and are 4 x 114.3, if you require a different PCD, Please contact us via email. Superlite wheels are liable to corrosion through time depending on the elements the wheel is exposed to will determine the life of the wheel. The wheels carry no warranty against this unfortunate fault.
9. VEHICLES FOR BREAKING
Please contact us directly regarding the vehicles we have available for breaking. Our stock changes daily and the pictures posted on our website may be of vehicles no longer being broke for spares. All used parts are non returnable unless damaged through delivery or are non operational.
10. CARS FOR SALE
D.M.B. Performance Imports began its life in the vehicle sales section of the trade. We pride ourselves on the high quality vehicles we supply and offer them at a discounted clearance price and due to this our cars are usually “Sold As Seen” unless otherwise stated in righting.
Some vehicles we sell have had light previous accident damage which has been repaired to the highest quality possible.
We also can arrange vehicles Imported directly from Japan, Australia & The USA which we can have shipped directly to you in any country in the world.
We have staff based in Japan, The United States, Australia and Great Britain / Rep. of Ireland who specialise in vehicle sourcing, Customs Clearance and Shipping ect.
PAYMENT
A deposit is required prior to sourcing commencement and full payment before shipping arrangements are made.
Payment can be made via wire transfer to our account
( A copy of the Sending Bank T/T must be faxed to us immediately following the transaction ),
or via Paypal
( A 3.6% Paypal fee applies to this option ),
or simply send payment by Cash, Cheque or Bankers Draft by registered post
( We do not recommend sending cash through the post, it may take up to 21 days for funds in the form of Draft or Cheque to clear into our account ).
We can hold a vehicle for no longer than 7 working days on deposit while we await full payment. If full payment fails to reach us by the 7th day, a fee of €400 will be applied and the vehicle will be listed for resale.
11. LEGAL ISSUES
All legal issues which are unlikely to arise, regardless to the customers country or area of residence will be solely limited to the Donegal jurisdiction of the Courts of the Republic of Ireland.
Irish Courts of Law
District Court:
The civil jurisdiction of the District Court in contract and most other matters is where the claim or award does not exceed €6,348.69
Circuit Court :
The civil jurisdiction of the Circuit Court is a limited one unless all parties to an action consent, in which event the jurisdiction is unlimited. The limit of the court's jurisdiction relates mainly to actions where the claim does not exceed €38,092.14
Civil actions in which all parties have not consented to the unlimited jurisdiction of the Circuit Court and the claim exceeds the limit of the Circuit Court, the case can be referred to the High Court in Dublin City.
P.N. Returns, Refunds and Replacement decisions are at the discretion of D.M.B. Performance Imports ( IRL ).
